NILES CANYON TRANSPORTATION CORRIDOR DOWNTOWN PLEASANTON - REAL PROPERTY LICENSE AGMT

April COUNTY OF ALAMEDA REAL PROPERTY LICENSE AGREEMENT THIS LICENSE AGREEMENT made and entered into this 15th day of 1993, by and between the County of Alameda, a political subdivision of the State of California, hereinafter referred to as "COUNTY and The City of Pleasanton, a municipal corporation, hereinafter referred to as "LICENSEE W I T N E S S E T H: WHEREAS, the County has a County Highway that it refers to as its "Niles Canyon Transportation Corridor Downtown Pleasanton Segment" County Road No. 8111, which is necessary for use as a transportation corridor in both the unincorporated area of the County of Alameda, Pleasanton Township and in the City of Pleasanton. Said property and highway thereon was acquired by a deed from the Southern Pacific Transportation Company re- corded February 28, 1989, as Document No. 89- 055743 at the Alameda County Recorder's office; and WHEREAS, the COUNTY is willing to allow its highway property to be occupied, so far as possible, by compatible uses if said uses do not interfere with COUNTY's use of the property for highway or transit purposes and until the COUNTY desires to retake possession of the highway for its exclusive use; and WHEREAS, it is not presently necessary for the COUNTY to use exclusively that certain portion of highway generally known and described as the Niles Canyon Transportation Corridor Downtown Pleasanton Segment more particularly shown highlighted in red on Exhibit "A" attached hereto and made a part hereof. NOW, THEREFORE, BE IT AGREED, that for and in consideration of the mutual covenants herein set forth and the mutual benefits to be derived by the parties hereto, COUNTY hereby confers to LICENSEE the license and privilege to use, subject to COUNTY's superior rights of possession, for the purpose of daily parking of vehicles and incidents thereto only, that certain portion of highway described above.
