In addition, the subject site is located within the Downtown Specific Plan (DSP) Area and is
<br /> therefore subject to policies of the DSP. The subject site is designated Medium Density
<br /> Residential and, like the General Plan, allows for a wide range of residential uses between two
<br /> and eight dwelling units per acre, consistent with the Zoning Ordinance. Thus, based on the
<br /> General Plan analysis above, the proposed use is similarly consistent with the DSP land use
<br /> designation.
<br /> Land Use
<br /> The subject parcel is zoned RM-4 (Multi-Family Residential, minimum 4,000 sq. ft. per unit),
<br /> where private schools are conditionally permitted. Accordingly, the applicant has applied for a
<br /> CUP. If the CUP were granted, the proposed private school would be consistent with the
<br /> applicable land use regulations.
<br /> One of the primary concerns in reviewing a CUP application is the effect of a proposed use on
<br /> surrounding uses. Staff believes the proposed use would be compatible with the surrounding
<br /> uses. The applicant has been operating a private school at various locations throughout the
<br /> City since 1992 (most recently at 5901 Coronado Lane), and while the public parking areas
<br /> around the church and surrounding blocks are heavily impacted during church services
<br /> (primarily on Sundays) as reported by neighbors (see Exhibit C), staff is not aware of any
<br /> additional issues with this operation or the existing church at the subject location. The private
<br /> school enrollment would be capped at a maximum of 25 students at any one time, but currently
<br /> only has an enrollment of 10 students and historically has enrollment numbers of less than 20
<br /> students. Accordingly, the increase in traffic and noise at and around the subject site would be
<br /> negligible. Moreover, none of the proposed private school activities would occur concurrently
<br /> with the existing church activities, further minimizing any impacts to the surrounding area.
<br /> In the past, the Planning Commission has granted CUPs within similar zoning districts for
<br /> similar uses associated with religious facilities, and these approved uses have not proven to
<br /> result in substantial issues or incompatibilities with surrounding uses in the vicinity. These
<br /> approvals include:
<br /> • The Child Day Schools, 883 Rose Avenue, RM-15 District;
<br /> • Creative Learners Child Care, 4300 Mirador Drive, Public District (surrounded by;
<br /> R-1-6,500 and same General Plan Designation as subject site);
<br /> • Harvest Valley Church/Adventures in Learning, 3200 Hopyard Road, RM-15 District;
<br /> • St. Clare's Church/pre-school, 3350 Hopyard Road, RM-25 District
<br /> Staff notes, although some of these facilities (e.g., Harvest Valley and St. Clare's church
<br /> preschools) are located along busier arterial streets than the proposed project, each of them
<br /> has some adjacency to residential uses. The first two examples noted (Child Day School and
<br /> Creative Learners), are both similarly surrounded by residential uses as the proposed project.
