PC-2022-06 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION FOR CONDITIONAL USE PERMIT (CUP) AND <br /> VARIANCE/PARKING VARIANCE LOCATED AT 118 NEAL STREET, AS FILED UNDER <br /> CASE NOS. P21-0715 AND P22-0126 <br /> WHEREAS, on July 27, 2021 and January 27, 2022, Bill Bryson, representing <br /> Lighthouse Baptist School, applied for: 1) a Conditional Use Permit (CUP) to operate a private <br /> school; and 2) a Variance/Parking Variance to allow all required on-site parking to be located <br /> at an off-site location not adjoining the subject site as required by Pleasanton Municipal Code <br /> (PMC) Section 18.88.050.A.; and <br /> WHEREAS, zoning for the property is RM-4 (Multi-Family Residential, minimum 4,000 <br /> square feet per unit) District; and <br /> WHEREAS, a private school is a conditionally permitted use in the subject District and <br /> requires Planning Commission approval of a CUP and a Variance/Parking Variance also <br /> requires Planning Commission approval; and <br /> WHEREAS, the project is categorically exempt from the California Environmental <br /> Quality Act (CEQA) pursuant to Section 15301, Class 1, Existing Facilities; and <br /> WHEREAS, on February 23, 2022, the Planning Commission held a duly-noticed public <br /> hearing and considered relevant exhibits, recommendations of the City staff concerning this <br /> application, and received testimony from the applicant and interested parties. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br /> Pleasanton, based on the entire record of proceedings, including the oral and written staff <br /> reports and all public comment and testimony: <br /> Section 1: Findings for Conditional Use Permit Approval <br /> With respect to the approval of P21-0715, the Planning Commission makes the following <br /> findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br /> A. That the proposed location of the conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purpose of the district in which the <br /> site is located. <br /> Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, <br /> workable relationship among land uses, protect existing land uses from inharmonious <br /> influences and harmful intrusions, and ensure public and private lands ultimately are <br /> used for the purposes which are most appropriate and beneficial to the City as a whole. <br /> As conditioned, the Planning Commission finds the proposed private school would be <br /> consistent with these objectives and would create more educational facilities within the <br /> City. The facility would be operated to not impact or interfere with the surrounding uses <br />atives to the proposal that could be considered by the Planning Commission include: <br /> 1.
