On November 17, 2020, in accordance with the provisions of PMC Section 18.144.010 <br /> — City Council Review, the Council called up the Commission's action up for review. <br /> Accordingly, the application is now before the City Council for review and action. <br /> DISCUSSION AND RECOMMENDATION <br /> For a complete project description and staff analysis of the application, please refer to <br /> the October 28, 2020, Planning Commission agenda report in Attachment 4 and the <br /> Commission's minutes in Attachment 5. Topics addressed in the agenda report include <br /> land use, amenities, employee density and traffic, site design, building design and <br /> massing, and project operation. <br /> As noted, the Commission's discussion and deliberations focused on the proposed <br /> building design and massing, particularly for the three-story building, use of the orange <br /> branding color, and the proposed amenities to be provided by the project. <br /> As proposed and conditioned, including modifications made to the project during the <br /> course of review, the Commission found that the proposed project was appropriate and <br /> was able to make all of the findings/criteria for approval of the Conditional Use Permit <br /> and Design Review applications. Therefore, staff recommends the City Council adopt <br /> the draft Resolution, Attachment 1, upholding the Commission's approval of the project, <br /> subject to conditions including, but not limited to, the condition removing the orange <br /> band from the three-story building. <br /> ENVIRONMENTAL ASSESSMENT <br /> A Consistency Checklist pursuant to the California Environmental Quality Act (CEQA) <br /> Guidelines Section 15183 was prepared for the proposed project. It is attached as <br /> Exhibit J to Attachment 4. The checklist concludes the proposed project would be <br /> consistent with the development density established by the existing zoning and General <br /> Plan policies for which the previous environmental impact report (EIR) was certified. <br /> Accordingly, it concludes that the project does not require additional environmental <br /> review. <br /> PUBLIC NOTICE AND COMMENTS <br /> Notices of this application and hearing were sent to surrounding property owners and <br /> tenants within a 1,000-foot radius of the site. Staff has provided the location and <br /> noticing map as Exhibit H to Attachment 4 for reference. At the time this report was <br /> published, staff received no public comments. Staff included the public correspondence <br /> received for the Commission meeting as Attachment 10. <br /> B. REQUEST FOR REDUCTION OF AFFORDABLE HOUSING FEE <br /> BACKGROUND <br /> The City of Pleasanton adopted its first low-income housing fee in the late 1970s. It was <br /> amended in 1989, 1998, 2003, 2012, and most recently in 2018. An underlying principle <br /> of the Affordable Housing Fee for non-residential development is that such uses <br /> generate demand based on new employees, many of whom may have difficulty finding <br /> Page 5 of 14 <br />
