On October 4, 2019, at the <br /> continued public hearing, the Zoning Administrator considered the project, including revisions <br /> made to address the neighbor's concerns, and approved the project. Subsequently, on <br /> October 21, 2019, Niraj and Harsha Gandhi filed an appeal of the Zoning Administrator's <br /> approval, citing similar concerns as those previously raised. <br /> BACKGROUND <br /> On May 17, 2019, the applicant submitted an Administrative Design Review (ADR) application <br /> to construct a second-story addition to the existing two-story home located at 7128 Moss Tree <br /> Way. The proposed addition, which would accommodate a new ADU, would be located above <br /> the garage on the west side of the house and accessed via a set of exterior stairs. <br /> Following public notice, Niraj Gandhi, resident to the immediate west at 7228 Moss Tree Way, <br /> contacted staff to express opposition to the project. Mr. Gandhi requested a hearing with the <br /> Zoning Administrator (ZA), which was held on July 25, 2019. At the hearing, Mr. Gandhi raised <br /> concerns regarding loss of privacy, blocking of natural light, and compatibility of the addition <br /> with his home and the existing neighborhood. The Zoning Administrator discussed the design <br /> of the project and continued the hearing with direction to the applicant to consider plan <br /> revisions to respond to the neighbor's concerns. The applicant subsequently proposed several <br /> revisions, including modifications to the stairway and window design, which the ZA considered <br /> at a continued hearing on October 4, 2019. Finding that the revisions appeared to address the <br /> identified issues, and based on findings of conformance with the criteria for Design Review <br /> approval, the Zoning Administrator approved the proposed project, subject to Conditions of <br /> Approval. On October 21, 2019, Mr. Gandhi filed an appeal of the Zoning Administrator's <br /> approval. The appeal is now before the Planning Commission. Minutes of the Zoning <br /> Administrator's hearings are attached as Exhibit D. <br /> SITE AND AREA DESCRIPTION <br /> The subject property is in the Pheasant Ridge development, located south of Bernal Avenue, <br /> between Bernal Park and 1-680. The existing residential neighborhood has a mix of one and <br /> two-story homes.
