<br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
<br /> PLEASANTON DENYING THE APPEAL OF NIRAJ AND HARSHA GANDHI
<br /> THEREBY UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL OF AN
<br /> ADMINISTRATIVE DESIGN REVIEW APPLICATION FOR A 480-SQUARE-FOOT
<br /> SECOND STORY ADDITION TO AN EXISTING TWO-STORY RESIDENCE AT
<br /> 7218 MOSS TREE WAY, AS FILED UNDER CASE NO. P19-0130
<br /> WHEREAS, on May 17, 2019, Nadia and Fayyaz Malik applied for an
<br /> Administrative Design Review Approval for the construction of a 480-square-foot
<br /> second-story addition to the existing two-story residence and an exterior stairway to
<br /> accommodate the Accessory Dwelling Unit (ADU) at 7128 Moss Tree Way; and
<br /> WHEREAS, zoning for the property is PUD (Planned Unit Development) District
<br /> where a residential use, including an ADU, is a permitted use; and
<br /> WHEREAS, pursuant to State law and the Pleasanton Municipal Code (PMC),
<br /> ADUs are considered a permitted use, but are nonetheless subject to design review in
<br /> accordance with PMC Chapter 8.20; and
<br /> WHEREAS, after public notice of the proposed project was sent, Niraj Gandhi,
<br /> resident at 7228 Moss Tree Way, reviewed the proposed plans on May 28, 2019, and
<br /> on June 3, 2019 requested a hearing on the proposal; and
<br /> WHEREAS, on July 25, 2019, the Zoning Administrator held a Zoning
<br /> Administrator's hearing and considered relevant exhibits, received testimony from
<br /> interested parties, continued the hearing, and advised the design be revised to respond
<br /> to concerns raised at the hearing; and
<br /> WHEREAS, on October 4, 2019, the Zoning Administrator held the continued
<br /> hearing and considered the revised exhibits, recommendations of staff concerning this
<br /> application, and received testimony from interested parties; and
<br /> WHEREAS, on October 4, 2019 the Zoning Administrator approved the revised
<br /> Administrative Design Review application subject to conditions of approval; and
<br /> WHEREAS, on October 21, 2019, a timely appeal of the Zoning Administrator's
<br /> approval was filed by Niraj and Harsha Gandhi; and
<br /> WHEREAS, on November 13, 2019, the Planning Commission held a duly-
<br /> noticed public hearing and considered relevant exhibits, recommendations of the City
<br /> staff concerning this appeal, and received testimony from interested parties; and
<br /> WHEREAS, this project is categorically exempt (Section 15301 , Class 1 , Existing
<br /> Facilities) from the requirements of the California Environmental Quality Act (CEQA).

<br /> 10 feet(one side)and 20 feet(combined).The existing home,as constructed, is set back 15 feet from the west property line
<br /> at its closest point,a larger setback than the standards would require. The proposed addition would be built directly above the
<br /> existing garage and would maintain the existing building setback.
