As staff are not aware of any litigation involving taxis <br /> operating in Pleasanton where insurance limits have been at issue, a change is proposed <br /> to require $100,000 for injuries to one person, $300,000 for injuries for 2 or more persons, <br /> and $50,000 for property per accident. <br /> $6.40.140 Time for processing taxi driver permit. Staff often need additional time to <br /> review background materials and get results from drug testing for taxi driver <br /> applications. The proposed modification provides for sixty days for application review. <br /> The existing code has no set review period, making some applicants expect an immediate <br /> decision. <br /> §9.24.040 & 413.08.190 Correct clerical error involving Ordinances 2125 and 2136. By <br /> Council action (Ordinance 2125) in August 2015, smoking was prohibited in parks and <br /> trails. Subsequently, by Council action (Ordinance 2136) in December 2015, smoking <br /> was also prohibited at Downtown special events. Due to clerical error, Ordinance 2136 <br /> did not incorporate the changes adopted by Ordinance 2125, so a correction is needed <br /> to properly reflect the changes adopted by both Ordinances 2125 and 2136. <br /> §11.08.020 City traffic engineer. Update reference to position of City Traffic Engineer to <br /> accurately reflect the current staff position. <br /> 611.36.020 Curb markings. Amendment to clarify that parking limits at white and yellow <br /> curbs can be time and date restricted per specific adjacent signage. <br /> 611.36.100 No parking zones. Amendment to Subsection H. to clarify that the traffic <br /> engineer can make adjustments to the "No Parking" zone near fire hydrants. <br /> 613.04.050 Prohibit private painting on public curbs. To prevent driver confusion and <br /> address public safety concerns, the description of prohibited encroachments (activities in <br /> the public right of way) is proposed to include prohibiting private painting on public curbs. <br /> This amendment addresses situations noted by the Police Department and Traffic <br /> Division about confusing permanent painted private markings and writings being made <br /> on public street curbs. <br /> Chapter 17.16 Clarification of Tree Preservation procedures. Amendments to clarify that <br /> when a proposed heritage tree removal is: (a) unrelated to new development, then <br /> appeals are heard by the Heritage Tree Board of Appeals; and (b) related to new <br /> development, then appeals per Chapter 18.144 (Appeals). Other clarifying amendments <br /> regarding certified consulting arborist, noticing distance for board of appeals hearings, <br /> mitigation options when trees are removed for new development, penalties when trees <br /> impermissibly removed during construction, and pruning guidelines. <br /> 618.124.070, 418.124.240, and §18.124.270 Correct internal references and a clerical <br /> error. Correct references to "objectives of zoning ordinance" when considering <br /> conditional use permit applications rather than only referencing Chapter 18.124 <br /> Page 3 of 4 <br />
