RECOMMENDATION <br /> Introduce attached ordinance and adopt both attached resolutions. <br /> FINANCIAL STATEMENT <br /> The amendment to the Master Fee Schedule provides for (a) California Vehicle Code set <br /> parking fine amount of $285 for blocking access to disabled parking space (which is <br /> enforced by existing Police Department traffic officers); and (b) recovery of City costs to <br /> annually conduct site inspection and verification of properties connected to the recycled <br /> water system by imposing a $100 annual fee (existing Operation Services staff from the <br /> Water Conservation Division have added this to their other duties). These amendments <br /> will result in $9,000 in additional City revenues for cost recovery, and an as yet <br /> undetermined amount for fines. <br /> BACKGROUND <br /> The proposed omnibus ordinance (Attachment 1), resolution amending the Master Fee <br /> Schedule (Attachment 2), and resolution authorizing the City Engineer to execute <br /> temporary right of entry agreements for construction projects (Attachment 3) is an annual <br /> process to present minor and non-controversial changes to the Pleasanton Municipal <br /> Code and Master Fee Schedule. City staff recommend code modifications to reflect <br /> actual City practices, delete former titles and references, make minor revisions, and <br /> correct clerical errors in the code. During the course of each year, staff compile such <br /> minor changes to present to the Council as one action. <br /> DISCUSSION <br /> The proposed omnibus ordinance and related resolutions address the following: <br /> §2.08.190 Authorize administrative regulations for the cemetery. California Health & <br /> Safety Code §§ 8115 and 8133 allow a public agency with a cemetery to adopt cemetery <br /> rules (e.g. standards for burials, maintenance, etc.). The amendment authorizes the City <br /> Manager to approve administrative regulations for the Pleasanton Pioneer Cemetery. <br /> 42.34.080 Change date of Library Commission meeting. The Library Commission <br /> desires to change the date of its regular meeting from the 2nd Thursday of each month to <br /> the 3rd Thursday of each month to avoid meeting conflicts. <br /> §5.24.010 Time period for business license payments and accepting postmarks. The <br /> code will be amended to state that annual business license payments are due between <br /> January 1-31st, and postmarks within that time period will be accepted. <br /> $6.40.050 Adjust taxi insurance requirements. Taxi cab owners have submitted a petition <br /> requesting that required insurance be lowered to better align with other jurisdictions <br /> (where many also operate). Pleasanton currently requires insurance in the amounts of <br /> $1,000,000 for injuries and $100,000 for property. Dublin requires $100,000 for injuries <br /> to one person, $300,000 for injuries for 2 or more persons, and $50,000 for <br /> property. Livermore requires $1,000,000 general liability and no property insurance. San <br /> Ramon requires no insurance (though State law has minimums of $15,000 for injury of <br /> Page 2 of 4 <br />
