w� <br /> KIER WRIGHT <br /> Civil Engineers Surveyors, Inc. <br /> The proposed improvements include the installation of utilities, curb and gutter, landscaping and <br /> sidewalk within the proposed new public road right of way. None of these items are inconsistent with <br /> the improvements one would expect to find in either a public or private roadway. None of these items <br /> will affect the ability of the residents to exercise their right to pass. An examination of the current <br /> physical alignment of Cameron reveals that only a portion of the original 58' wide "roadway" is <br /> available to the residents to traverse. This does not pose a problem until one begins to view this old <br /> 58' wide "roadway" easement as some sort of zone That must he maintained free and clear of any and <br /> all obstructions. If one feels that this "clear zone" is a requirement then one must apply this principal <br /> to the entire length of the old Cameron. This seems impractical as it would necessitate. for example <br /> in that portion from Courtney to Martin. the removal of the curb and gutter along the south side of the <br /> street along with approximately 7'-8' of the front yard improvements including driveways. <br /> landscaping and other features that currently pose an obstruction to free travel. <br /> Modern roadways, either public or private. need to he designed and constructed in accordance with <br /> current municipal and/or State design standards. It is impractical (and possibly dangerous) to expect <br /> that Cameron Avenue should he constructed along its entire length to a clear traveled way width of <br /> 58'. If the possible holders of the private rights in this old ancient road easement expect this to apply <br /> to the area along the Tract 7721 frontage then they should be prepared to extend that expectation all <br /> the way to Martin Avenue. <br /> The dedication of Cameron Avenue by the developer of Tract 7721 to the public will in no way serve <br /> to extinguish any private rights that may exist by virtue of this ancient 1894"roadway"easement. The <br /> heneliciaries of this easement have the right to enjoy access to their properties along Cameron. <br /> however they do not have the ability to prevent the owner of the land from granting additional rights <br /> • to others. The proposed physical roadway provides the same ability to access as the existing physical <br /> roadway. The proposed dedication should he of benefit to both the residents and the public as there <br /> now will be a full publicly maintained roadway accessing this neighborhood. <br /> We would be happy to meet with you or City Staff to discuss this smatter further.
