RECOMMENDATION <br /> 1. Find that the proposed project will not have a significant environmental impact <br /> and adopt the draft resolution approving the Negative Declaration (Attachment <br /> #3); <br /> 2. Find that the proposed PUD development plan modification is consistent with the <br /> Pleasanton General Plan; <br /> 3. Make the PUD Development Plan Findings 1 through 7 as stated in the Planning <br /> Commission staff report (Attachment#14); <br /> 4. Introduce the draft ordinance approving Case PUD-50-01M the development <br /> plan modification for 31 total lots and to construct 29 new detached one-story <br /> single-family homes, subject to the Conditions of Approval, Exhibit "A" <br /> (Attachment #1); and, <br /> 5. Adopt the draft resolution approving the amendment to the Affordable Housing <br /> Agreement (Attachment #4). <br /> FINANCIAL STATEMENT <br /> The proposed development would have a negligible financial impact on the City. <br /> Increases in property and sales taxes would be used to provide services, such as <br /> police, fire, etc., for the increased demand generated by the 29 new residences of the <br /> 31-lot development. The applicant would also pay development impact fees (e.g., <br /> lower-income housing fee per the proposed Amended Affordable Housing Agreement, <br /> public facilities fee, traffic fees, water/sewer connection fees, etc.) that are used to pay <br /> for the cost of new City facilities and infrastructure necessitated by development. <br /> BACKGROUND <br /> A detailed narrative of the permit history of the Lehman-Selway property is included in <br /> the BACKGROUND section of the attached Planning Commission staff report <br /> (Attachment #14). The narrative covers RZ-97-02, that prezoned Lehman-Selway <br /> property with the remaining unincorporated area of the Mohr-Martin area to the PUD- <br /> LDR District in compliance with the Pleasanton General Plan; PUD-50, that approved <br /> the PUD Development Plan entitling the Lehman-Selway property to 27 lots (comprised <br /> of 25 new one- and two-story homes and two existing homes), and on- and off-site <br /> street construction; and Vesting Tentative Subdivision 7721, that subdivided the <br /> Lehman-Selway property in compliance with the PUD-50 development plan and <br /> addressed street and utility improvements and construction, dust control measures, and <br /> vermin abatement. <br /> California State Assembly Bill 333 and Senate Bill 1185 extended Vesting Tentative <br /> Subdivision Map 7721 for this development to expire on January 15, 2012. On <br /> February 8, 2010, the Director of Community Development approved the second <br /> Page 2 of 16 <br />
