Based on the results of the consultant's field survey (Attachment #12), <br /> the location of the survey monument is correct, and the locations of the Cameron <br /> Avenue street right-of-way is accurately shown on the PUD development plan. <br /> Mr. Woodall retains title to the portion of Cameron Avenue and Courtney Avenue <br /> by his property. Staff located a grant deed (Attachment #8) in which the former <br /> owners of the Woodall property dedicated the portions of their property within the <br /> street rights-of-way for Cameron Avenue and Courtney Avenue to the City, <br /> changing them from private streets to public streets. Although the document that <br /> included Mr. Woodall's property (Lot 13) and the neighbor's property on the south <br /> side of the Woodall property (Lot 9, 1781 Courtney Drive) was signed and <br /> notarized, it was not recorded with the Alameda County Recorder. This issue <br /> does not affect the development of the Lehman-Selway property. Staff considers <br /> it to be an anomaly that can be corrected by recording a new deed transferring <br /> title from these properties to the City of Pleasanton. <br /> For background, Cameron Avenue, Courtney Avenue, Nicole Avenue, Equestrian <br /> Drive, and Diablo Court of the BAS Homes Development Unit One were originally <br /> approved on Final Subdivision Map 5445, recorded in September 1986, as <br /> private street reservations. Final Map 5445 indicates that these private street <br /> reservations are to meander along the edges of the property lots created by the <br /> Final Map, and that these private street reservations are to be used "for <br /> assignment of access rights to others in the future." Notes on the Final Map say <br /> that the private street areas will "be dedicated by separate instrument." <br /> On May 5, 1987, prior to the separate access easements being dedicated for the <br /> private streets, or the streets being constructed, the City Council introduced <br /> Ordinance No. 1311 (Attachment #7) for PUD-83-10-03M, PUD-83-12-02M, and <br /> PUD-86-15-01M. Through this City Council action, it was determined that these <br /> streets would not be private, but would be accepted as Public Street Rights of <br /> Way. This action was deemed necessary to provide proper emergency response <br /> access as required by the General Plan. BAS Homes was directed to prepare <br /> and provide to the City the deeds transferring title of the street area from the lot <br /> owners to the City. <br /> On October 4, 1988, the City Council approved Resolution No. 88-460 <br /> (Attachment #7) that accepted all necessary deeds for the public streets and <br /> instructed the City officers to take appropriate action. All accepted deeds were <br /> recorded in 1988, with the exception of the document that contained the transfer <br /> of land on the Woodall property (Lot 13) and Lot 9. Not recording this one <br /> document appears to be clerical oversight, as later in 1988 improvement plans <br /> for the streets were reviewed and approved for construction. After the <br /> construction was completed, the City accepted the improvements, including the <br /> portions of Cameron Avenue and Courtney Drive by the Woodall property, as <br /> public streets.
