The information a-mail confirms that the applicant worked with a neighbor to reduce impacts
without City involvement. E-mail comments and related correspondence are provided in
Attachment C.
VII. FINDINGS
The Planning Commission needs to make the following use permit findings prior to approving a
conditional use permit. These findings must relate to the specific proposal being made.
1. The location of the proposed conditional use is in accordance with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.
- The subject site is located in the R-1-6500 Single Family Residential District. The
keeping of fowl is a conditionally permitted use in the R-1 District. The applicant's
keeping of chickens is incidental to the use of the property as asingle-family
residence. This finding can therefore be made.
2. The proposed location of the conditional use and the conditions under which the
conditional uses would be operated or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious to the properties or improvements in
the vicinity.
- Based on site visits by staff, both the chicken coop and chickens located at the subject
property are well maintained. This finding can therefore be made.
3. The proposed conditional use will comply with each of the applicable provisions of
Chapter 18.124 of the Pleasanton Municipal Code.
- The proposed conditional use will comply with all applicable sections of Chapter
18.124 of the Pleasanton Municipal Code and meets all applicable standards. This
finding can therefore be made.
For this reason, staff believes that proposed project complies with the provisions of the Zoning
Ordinance. Therefore, this finding can be made.
VIII. ENVIRONMENTAL ASSESSMENT
Pursuant to the California Environmental Quality Act (CEQA) Section 15061(b)(3), this activity
is covered by the general rule that CEQA applies only to projects that have the potential for
causing a significant effect on the environment. Staff finds that there is no possibility that the
activity in question will have a significant effect on the environment. Therefore, this activity is
not subject to CEQA and no environmental document accompanies this report.
Case No. PAUP-2 Planning Commission
Page S
