The roll call vote was as follows: <br />AYES: Councilmembers Campbell, Dennis, and Mayor Pico <br />NOES: Councilmembers Ayala and Michelotti <br />ABSENT: None <br />ABSTAIN: None <br /> <br />There was a break at 10:25 p.m. <br /> <br />The meeting reconvened at 10:35 p.m. <br /> <br />Item 6c <br />PUD-02-04M and PCUP-61, Bernal Partners, LLC <br />Application for PUD development plan and conditional use permit approval for a self- <br />service gasoline station consisting of six fuel pumps, a 2,500-sq. ft. convenience market, a <br />2,500-sq. ft. quick-service restaurant with drive-through lane, and a modification to the <br />Bernal Properties PUD development plan to allow a 1,300-sq. ft. drive-through carwash, <br />and beer and wine beverage sales from the convenience market, on an approximatelv 1.3- <br />acre site located at 1875 Valley Avenue (southeast corner of Bernal Avenue and the Valley <br />Avenue extension). (SR 02:215) <br /> <br />Brian Swirl presented the staff report. <br /> <br /> Mark Hirsch, Bernal Partners, LLC, 40931 Fremont Boulevard, Fremont, felt he had an <br />excellent product and introduced the other members of his team who would be making <br />presentations. He asked for a show of hands of those who supported the project and many <br />people in the audience responded. He also referred to petitions, letters of support and emails in <br />support of the project. <br /> <br /> Donald Ruthroff, Dahlin Group, Inc., 2671 Crow Canyon Road, San Ramon, described <br />the architectural features of the project and noted the changes made at the suggestion of the <br />Planning Commission. He presented an animated view of the proposed project from various <br />angles. <br /> <br /> Mr. Campbell asked if it were confirmed that the service station would be a Shell station <br />and if it were not, would the colors change? <br /> <br /> Mr. Ruthroff said it is not confirmed. If it were a Chevron station the colors would be <br />compatible with that vendor's color scheme. That would go to the Planning Commission for <br />approval.
