Ms. Ayala restated her motion to revoke the permit as of November 30 pending <br />receipt of a new conditional use permit application that would address issues of access, <br />square footage, occupancy, and related issues. <br /> <br /> Ms. Michelotti asked if there would be an ability to extend the revocation if the owner is <br />in the process but not quite ready? <br /> <br /> Mr. Roush said the applicant would have to come to Council to request the extension; it <br />would not happen automatically. <br /> <br /> Ms. McKeehan said at that heating Council would decide whether to revoke or extend the <br />permit. <br /> <br />Ms. Michelotti seconded Ms. Ayala's motion. <br /> <br /> Mr. Campbell did not agree with the amendment. He felt the issue was not the plan but <br />the implementation of the plan. The owner must be able to prove that the plan works. He felt it <br />was better to let the club continue to operate with conditions and see if they can implement <br />programs to alleviate the problems. <br /> <br />Mayor Pico did not feel there was a consensus to immediately revoke the permit. <br /> <br /> Ms. Michelotti suggested a review in November on the progress made and whether the <br />owner has submitted a plan. <br /> <br /> Mayor Pico said the motion as amended does not address the occupancy level or the <br />access, it just says the permit will be revoked unless the owner does something else. <br /> <br /> Ms. Ayala withdrew her amendment to her motion and the vote was called on the original <br />motion to revoke the conditional use permit. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala and Dennis <br />NOES: Councilmembers Campbell, Michelotti, and Mayor Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Mayor Pieo, seconded by Mr. Campbell, to adopt Resolution No. <br />02-099, amending the conditional use permit to limit occupancy of the Marque Nightclub to <br />no more than 200 people, to require the access to the club be towards the rear of the <br />building near the Chabot Drive area, and to require a subsequent review of the conditional <br />use permit and the issues and problems with the neighborhood no later than the end of <br />January of 2003. <br /> <br />Pleasanton City Council 23 09/03/02 <br />Minutes <br /> <br /> <br />
