Ms. Michelotti said it is obvious there have been problems even though they have <br />diminished somewhat because of the change in music and other steps taken by the owner. She <br />agreed with Ms. Ayala that Council is trying to put something together when all the pieces are <br />not in place. She wanted to find the best format to accomplish that. She felt this may not be the <br />best location for this type of business. She remembered when this was a restaurant and there <br />were no problems. She wanted to hear other Council comments. <br /> <br /> Mr. Campbell wanted to be sensitive to the neighborhood. The location of the club may <br />not be in the best location, but he felt the owner had done a good job of implementing changes. <br />He liked the suggestions of Mayor Pico about different uses, different entrances/parking, etc. He <br />did not want to revoke the permit. He did not think Carlos was a victim of success, but rather of <br />poor management of getting people out of the club and out of the parking lot. He wanted to <br />continue to work with Mr. Ratinho and the neighborhood to make sure he keeps his business and <br />that the conditions are such that the neighborhood is satisfied. He supported the rear entrance, <br />parking lot and reduction of occupancy. <br /> <br /> Ms. Michelotti was still concerned that the problems would just be shifted to the back and <br />would affect the residence hotels located there. She was concerned that the Marque needed <br />sixteen security personnel to manage the place. She wanted the right process to allow the owners <br />to come back with a plan. <br /> <br /> Mayor Pico believed there has been some progress with respect to mitigation of problems <br />at this location. He would like to give more time to resolve the issues, whether it is to convert <br />part of the building to a pizza parlor or whatever. He would like to keep the ability for <br />subsequent review of the business after the first of the year. He felt if the occupancy was <br />significantly limited to 200-225, then the security could handle the situation. He also felt if the <br />access were moved to the rear near Chabot Drive, the traffic would be shifted to the rear of the <br />building. It could be determined whether that would create a problem for the hotels or not. He <br />felt limiting occupancy, modifying the access, and having a subsequent review would allow the <br />owners additional time to provide a business plan for the front of the building. He believed this <br />was reasonable. If in three months there is still a problem with neighborhood complaints, then <br />Council can review it again and revoke the permit if necessary. <br /> <br /> Mr. Campbell agreed to give the owner a chance to make changes. If it doesn't work, <br />then Council can revoke the permit. <br /> <br /> Ms. Michelotti was uncomfortable doing all this before the owner has a plan to bring <br />forward. <br /> <br /> Mayor Pico said this allows the owner to keep his doors open while forming a plan. He <br />knows young people who like this kind of club and felt there was a need for this kind of <br />establishment without going to San Francisco or elsewhere. <br /> <br /> Ms. Michelotti asked how this was to be implemented. Is half the square footage to be <br />immediately converted to a pizza parlor? There was also a question about tenancy. She felt <br />there were many questions that needed answers.
