If that can't be done, then the City reviews the matter to determine <br />whether more serious solutions such as suspension, revocation, or major changes to the business <br />are necessary. <br /> <br /> Ms. Dennis asked ifa pizza parlor was a permitted use that does not need a conditional <br />use permit for. <br /> <br /> Mr. Swift said that was true so long as it did not serve alcoholic beverages after ten <br />o'clock. <br /> <br /> Ms. Dennis asked if Council considered additional conditions to the permit, could it <br />restrict the amount of square footage dedicated to that particular use in addition to limiting the <br />occupancy. In other words, we could shrink the size of the club as though the pizza place were <br />there already. <br /> <br /> Ms. Ayala was uncomfortable in reviewing the pizza parlor uses as if Council were <br />forming a work plan for Mr. Ratinho's business. She felt that should go back through the <br />permitting process so the owner can bring his own work plan for review. She felt too many <br />changes were being proposed tonight. <br /> <br /> It was moved by Ms. Ayala, seconded by Ms. Dennis, to revoke the conditional use <br />permit and suggest the owner go back through the planning process to open the pizza <br />parlor and bring a work plan as soon as possible. <br /> <br /> Ms. Dennis said she seconded the motion to allow Council discussion. She felt the club <br />may have been a victim of its own success. The permit has been in place since 1995. The club <br />is a success and is attractive, but she felt it was having difficulty managing. She felt sixteen <br />security guards was a lot. She was concerned that eventually the additional restrictions of the <br />conditional use permit could become oppressive and impossible to enforce. She appreciated the <br />speakers in support of the club, but somewhere along the line something has gone awry with this <br />club that has not occurred since 1995. There are different crowds and different expectations of <br />the patronage. It is not necessarily a bad thing, but is not working in that location. <br /> <br /> Ms. Michelotti wondered if this was an appropriate place for a club to operate. From <br />1995 until a year and a half ago, a similar club did operate. She commented that a conditional <br />use permit is for a use that is allowed under certain conditions, unlike a pizza parlor that is <br />allowed as a permitted use. She asked if staffand Council should consider whether this is the <br />proper location for a club to exist so close to a neighborhood. <br /> <br /> Mr. Swirl said staff felt a club this size with the parking lot in use along Hopyard Road <br />would not be able to control the problems that have occurred, particularly in summer.
