Ms. Michelotti asked if he had security guards at his restaurant.

Mr. Berman said he did not. He was the security. He also said not every security person
has to have a license. If one person in a company has a license, the other employees do not have
to be licensed.

Mike Denu, 7715 Fall Creek Road, Dublin, said he also frequents the Marque as well as
other bars. He used to bartend at Shaboom. When he is in the Marque he feels safe and likes the
diversity of the crowd and the music and sees no problem and anything different than anywhere
else. He stopped going to Masse's because he did not feel comfortable there. He felt it would be
a great disappointment if the Marque were closed. It is a great place to go.

Alonzo Grigsby, 6420 Stoneridge Mall Road, #M114, said he also frequented the Marque
and he has not seen any violence in the area or tire screeching in the parking lot. It is a great
place to meet friends and coworkers and he would be sad to see it closed.

Terrah Cabral, 7925 Peachtree Avenue, Newark, said she frequents the Marque and it is a
great club. She felt people from the other side of the hill like coming to this area. She asked
Council to keep it open.

Cheryl Cabral, 7925 Peachtree Avenue, Newark, asked Council not to take away the
livelihood of the employees of the Marque. She has been to the club several times and did not
find the parking lot to be noisy.

Rich Cabral, 7925 Peachtree Avenue, Newark, father of Richie Cabral, said he was at the
Marque on New Year's Eve and found nothing unusual. It is a nice club for the younger
generation. He thought it would be fair to give them an opportunity to solve the problems.
Carlos is a young family man and has invested a lot of money in this business. He was unaware
of the opportunity to sell before September. Mr. Cabral said he and his wife had been at the
Marque several times and found no problems. On one occasion he left the Marque and went to
Shabooms, where it was more rowdy than the Marque. He urged Council to give Carlos a
chance to be successful as he is with his other business at Mountain Mike's.

Jason Frank, 2635 Contra Costa Boulevard, Pleasanton Hill, representing the bartending
staff, felt the Marque was a safe place and if closed would affect his income and livelihood. He
is also the owner of a small limited liability corporation called Evolution Studios. It does live
sound work, studio work, DJ work. He felt that the statement saying a person could feel the bass
inside a house was pushing the limit. He said outside work, such as in parks, have a 110dB limit
and from a quarter mile away, the only thing that could be heard were some high pitched sounds.
He said the bass is minimal from outside the club.

Abigail Bruno, 2656 Northwood Drive, San Jose, indicated she was a patron of the
Marque and felt it was a safe place and well mn. She has never seen problems outside or inside
the club. She heard there were complaints about noise and felt any time there is a large crowd
leaving a building, there would be some kind of noise. She has seen security exercising major
efforts to disperse the crowd in an orderly fashion. She felt the Marque was an asset to the

Pleasanton City Council 16 09/03/02
Minutes
