community because it provides jobs. She knows employees who work there who would lose
their jobs if the club were closed. She asked Council to work with the Marque to keep it open.

Kevin Hall, 3315 San Felipe Road #73, San Jose, said he has been in the human resource
field for nine years and most of his diems are Fortune 500 companies in the Th-Valley area.
These companies do not have the funds these days for job fairs, advertising, etc. and rely on him
to find creative ways to find employees for them. He uses the Marque to do that. He represents
IT professions that live in the Th-Valley area. They know they can come to the Marque with
their resumes and he can introduce them to tilring managers that come to the Marque. This
process saves companies thousands of dollars and is good for his own business. He felt closing
the Marque was closing that avenue to job opportunities. If there is a noise problem, he felt there
was a solution that could be found. He said several law enforcement personnel frequent the
Marque in an informal fashion to have fun and they consider the place very safe.

Mr. Campbell asked if he had already had a "resume night".

Mr. Hall said he had and it was very successful. He plans to make it an ongoing practice.

Mark Cohen felt his client and the audience expressed themselves well. This is a good
group of people who have made a sincere effort to do the fight thing and have demonstrated
responsibility. The owner is welling to work with the City to resolve the problems. They just
want a chance to make this work for everyone.

Ms. Michelotti asked if the owner has discussed with City staff changes in hours of
operation?

Mr. Cohen said there has not been an opportunity to have those discussions and staff has
not made those suggestions. Carlos has developed the proposal before Council and there was not
a lot of time to deal with this. In terms of hours, he said it was crucial for the club to be open
until 2:00 a.m. The ordinance permits that. They were prepared to reduce the occupancy to 275,
but that is not written in stone and they can work with staff to see what could mitigate the alleged
problems during the time they are implementing their changes.

Ms. Michelotti referred to the change to a new use of a pizza parlor, and asked if that
would be closed at 10:00 pm.

Mr. Cohen said yes. That would close at ten, but that would not preclude the use of the
banquet facility beyond that time as a banquet facility or as a club the way it is operating now,
except for the capacity which would be much less. He could not present specific details at this
stage without going through the city process.

There were no further speakers and the public hearing was closed.

Mayor Pico referred to previous statements about the change of ownership and whether
there was an appropriate change of ownership of the conditional use permit and asked staff if it
were satisfied that everything that had taken place was proper.

Pleasanton City Council 17 09/03/02
Minutes
