should be changed. They talked about being compared to Toby's and Masse's, but he did not
feel it was the same situation at all. There were no houses near Masse's and Toby's was a
problem with loud music from ten to midnight. This is a problem with people in the parking lot.
He hears loud voices and tires screeching. He indicated he has spoken to representatives of
Tommy Thompson and the owners of the shopping center and he did not believe there was a
lease. He did not understand what all this issue of Mr. Ratinho wanting to keep going with this
is about. The residential area was there long before the shopping center or the bar. It was a
mistake to grant the original conditional use permit. It is the wrong kind of place to have in that
shopping center. Every other establishment closes earlier in the evening. The petition presented
by the Marque said the music doesn't bother the people who signed it. That is because their
businesses are closed. He has been living with this for a year and a half. He talked to Mr.
Ratinho, who seems like a nice guy. He has no problem with any of them personally. He said
many of his neighbors could not be here because they have children in school. He said he will
leave and take his son home to watch the rest of this meeting on television.

Carrie Hummel, 5358 Case Avenue, said she works for a high tech finn and she plans
events. She has done business with the Marque and complimented them on their professionalism
and the things they provided for her far exceed many other events she has worked. If Council
revokes the conditional use permit, she felt it would take away a facility for Pleasanton, would
take away jobs and would take away a place she enjoys throwing her events at and giving her
business to. If it closes, she would not bring her business back to this area. She is a resident, but
works in San Jose. She brings her employees here and has customer events as well.

Maurice Armijo, 3145 Geary Boulevard, San Francisco, indicated he is a patron every
Friday. He feels safe there and chooses to socialize there. He would regret its closure.

Steven Berman, 5331 Hopyard Road, owner of the Buttercup Pantry, said he frequented
the Marque and knew the owners well. He has been in the restaurant/nightclub business for 25
years. He said there is always a problem with late night businesses. He has a 24-hour restaurant
and has had people making noise in the parking lot. The closure of the Marque may be good for
a few people, but in the big picture it will not be good for many others. In his case, on Thursday,
Friday and Saturday nights 50% of his business comes between 1:00 a.m. to 3:30 a.m. The first
hour from 2:00 to 3:30 a.m. is from the Marque. That includes their employees and the owner.
He also gets business from Masse's. Not once has he had to call the police because of their
patrons. He related a few incidents, none of which involved the Marque patrons. He has talked
to the people at the Shell Station and Chevron Station. He felt the problem was too many people
coming to the Shell Station at once. He felt the people came from many different businesses.
His business thrives on the entertainment industry. His restaurant gets clients from far and wide,
but the biggest pa~t of his business is from Pleasanton. He said different people like different
kinds of music and you can't stop people from living because a couple of people can't close their
windows. He said at the end of the his day on Friday and Saturday, he drives by Marque to see if
he will get a lot of customers from them and he has not observed the noise problem. He said
Hopyard is a busy street at that time of night. The bars downtown are still open and those people
will drive from downtown to his restaurant. He felt the Marque patrons and employees are
mature. He asked Council not to close the nightclub.

Pleasanton City Council 15 09/03/02
Minutes
