Mr. Roush explained that the New Cities representative had indicated that it <br />would be willing to pay for its share of the infrastructure and do its share of the bypass <br />road without the need of a development agreement. It was waiving any objection it might <br />have to a lack of nexus between that condition and the project. The development <br />agreement does not have to be a part of the motion. <br /> <br /> Mayor Tarver agreed to remove the development agreement for New Cities from <br />his motion. <br /> <br /> Ms. Ayala was not comfortable with that. What do we have without the <br />development agreement? <br /> <br /> Mayor Tarver agreed, but if staff can assure him that the City can accomplish its <br />goals without the agreement, he would accept that. <br /> <br /> Ms. Acosta suggested the vote could include the development agreements and <br />then pull them later at the second reading. <br /> <br /> Ms. Dennis did not think these projects should be conditioned on approval of the <br />annexation. She did not think New Cities should pay for water and sewer infrastructure. <br />The developers within the Happy Valley Specific Plan have agreed to pay for it. <br /> <br /> Mr. Pico was concerned about saying the City would not proceed with the bypass <br />road, because that is in conflict with the Specific Plan. <br /> <br /> Mayor Tarver indicated the City would not proceed at this time. It does not rule <br />out the road. It only pertains to the road through SummerHill. It also pertains to the City <br />doing the work at this time at its expense. <br /> <br /> Ms. Michelotti asked if this motion says there is no golf course without <br />annexation. <br /> <br /> Ms. Acosta said the motion means the golf course is conditioned on annexation, if <br />annexation fails, then staff will come back to determine what to do about the golf course. <br />There may be another way to annex the property. <br /> <br /> Mayor Tarver explained that normally an annexation is approved before a PUD, <br />but he is saying if there is no annexation, there is no plan. <br /> <br /> Ms. Ayala felt it would have been helpful for Happy Valley to have a unanimous <br />Council vote to show we are dedicated to the golf course, committed to working on a <br />bypass road and they will have sewer and water. <br /> <br />Pleasanton City Council <br />Minutes <br /> <br />29 10/19/99 <br /> <br /> <br />
