neighborhood has negotiated from 69 units down to 48 units and a lot has been <br />accomplished. This is consistent with the Specific Plan and General Plan and has <br />satisfied the neighbors. She supported this and felt this project stands on its own with the <br />additional support of the neighborhood. She wants the open dedication now that is not <br />specific as to location and it is still possible there will be no trail. She also recommended <br />narrowing the access road. <br /> <br />Mayor Tarver asked staff to say whether the development agreement is good. <br /> <br /> Mr. Roush indicated staff feels there is a good agreement assuming the PUD is <br />approved because it requires the developer to contribute its prorata share of the Happy <br />Valley infrastructure, and to construct a portion of the bypass road. In exchange for that, <br />the developer has assurances that it can build the project as proposed and that if a CAPP <br />Initiative passes, it will not be precluded from proceeding. The only issue is growth <br />management allocation, which does not have to be part of the development agreement. <br /> <br /> Ms. Acosta stated the development agreement is the only way the City can secure <br />the water and sewer financing for Happy Valley. <br /> <br /> Ms. Michelotti pointed out the other thing it accomplishes is that water and sewer <br />is done right away with the golf course project. <br /> <br /> Mayor Tarver said this was before the offer of Black Mountain. If we approve <br />this but growth management waits until the growth management report and allocation is <br />based on availability of infrastructure, there is still a PUD and we don't need a <br />development agreement. <br /> <br /> Mr. Roush said without the development agreement there would be no legal <br />obligation for New Cities to provide infrastructure for Happy Valley. <br /> <br /> Ms. Ayala believed that if the annexation is not approved, then the golf course is <br />totally gone. <br /> <br /> Mr. Roush stated that if the annexation is not approved, then the Council could <br />consider that the PUD will not be approved either. <br /> <br /> Ms. Michelotti asked why that would be done for this project.
