There is no assurance that the bypass <br />road would be built. <br /> <br /> Ms. Seto said that was correct. If he were not able to process the agreement, he <br />would lose his vested rights under the agreement. <br /> <br /> Ms. Michelotti asked if there was a limit on the maximum number of units, but <br />not on the minimum allowed. <br /> <br />Ms. Seto indicated there was no guarantee of density. <br /> <br />Mayor Tarver declared the public heating open. <br /> <br /> Craig Chumpion, 777 Califomia Avenue, Palo Alto, representing Summerhill, <br />stated this development is part of a master planned community. The developer is trying <br />to get the golf course bypass road and provide water and sewer infrastructure for the area. <br />The developer was disappointed by the Planning Commission' s decision and felt the plan <br />was in compliance with the Specific Plan. He responded to the concems mentioned. He <br />felt there was a big difference between denial of a project and imposing conditions. He <br />felt denial had to be based on strong disagreement or obstacles. First, the geotechnical <br />area of concem is in a medium density area and a professional consultant has indicated <br />this is not a large slide area compared to the rest of the Bay Area and it can be repaired. <br />The developer has done this on other projects. The peer review has acknowledged that <br />this can be addressed. This is not an impossible problem to solve.
