205 <br /> <br /> It was moved by Councilmember_Butler, and seconded by <br />Councilmember Mohr, that on the basis of a review of an initial <br />environmental study done for this project and a finding that no <br />significant environmental impact would occur as outlined in the <br />City's guidelines and a further finding that a negative <br />declaration is appropriate in connection with PUD-85-15-1M, the <br />application of Golden Eagle Farms for a major modification to an <br />approved development plan for a 210-unit residential project to <br />allow for a special events/conference center to be established at <br />the facility approved for a clubhouse (Bernal Adobe) to be located <br />at 1780 Foothill Road, that Resolution No. 89-203 be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmembers Brandes and Tarver <br /> <br /> It was moved by Councilmember Mohr, and seconded by <br />Councilmember Butler, after finding that the proposed use (1) is <br />consistent with the General Plan, (2) furthers the purposes of the <br />PUD District, and (3) is complementary to the overall Golden Eagle <br />Farms PUD, that Ordinance No. 1417 be introduced, to be read by <br />title only and waiving further reading thereof, approving PUD-85- <br />15-1M, the application of Golden Eagle Farms for a major <br />modification to an approved development plan for a 210-unit <br />residential project to allow for a special events/conference <br />center to be established at the facility approved for a clubhouse <br />(Bernal Adobe) to be located at 1780 Foothill Road, subject to <br />conditions set forth in Exhibit A of Staff Report 89:199. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmembers Brandes and Tarver <br /> <br />item 6f <br />Protest Hearing on the Resolution of Necessity - Kolb Property <br /> Mr. Roush presented his report (SR 89:194) dated May 2, 1989, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the item. <br /> <br /> No one in the audience spoke in favor of or in opposition to <br />the matter. <br /> <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Resolution No. 89-203, determining that <br />the public interest and necessity require the acquisition of <br />certain land on Dublin Canyon Road and directing the filing of <br />eminent domain proceedings, be adopted. <br /> <br /> - 8 - 5-2-89 <br /> <br /> <br />
