Mr. Pico felt the homes that go in should comply with the original development standards
with the 20 foot separation between the houses. He felt the three-car garage design did not fit
the character of the neighborhood.

Ms. Dennis commented that these homes need to fit well with those older neighborhoods.
The greater separation between the houses might do that, perhaps with less garage.

Mayor Tarver stated that there has been a lot of concern from the beginning about visual
impacts and about what those impacts do to the existing neighborhood. He wanted to live up
to the original approval and had a concern about the massing of garages on small lots.

It was moved by Mr. Pico, and seconded by Ms. Dennis, to adopt Resolution No.
95-133, dening the application of PanCat Development Company filed under Case
PUD-90-18-1M and PUD-90-18-2D.

The roll Call vote was as follows:
AYES: Councilmembers Dennis, Pico, and Mayor Tarver
NOES: Councilmember Michelotti
ABSENT:
ABSTAIN: Councilmember Mohr

Item 6f
AP-95-10 (V-95-15 and Z-95-168} - Robert and Suzanne Ernest
Appeal of the decision by the Planning Commission to approve the request by the applicants
for a variance from the Pleasanton Municipal Code and for design review approval to allow
an existing, approximately 15'0" tall gazebo within the required front yard of a single-
family lot. (SR95:382)

Brian Swift presented the staff report.

Mayor Tarver asked when the gazebo, if placed closer to the resident that is complaining
about the gazebo, would meet code.

Mr. Swirl stated that the gazebo is fourteen feet from the Cravottas' property line and
twenty feet from the front property line. If it were moved back five feet so as not to need the
variance, it would be twenty-five feet from the front of the property and nine feet from the
Cravottas' property, which is four feet further than the Code requires. Since the structure is
over ten feet tall, it still needs to meet the requirements for design review.

Mayor Tarver asked how the setback is defined.

Mr. Swirl replied that a setback is defined to follow a line parallel to the curb made by
the bulb.

11/21/95 -9-
