Mayor Tarver stated that even though the gazebo is nonetheless twenty-five feet away
from a portion of the bulb on the cul-de-sac, the distance is measured from that portion of the
cul-de-sac where the gazebo is located.

Mr. Swift agreed; the twenty-five setback is parallel to the bulb of the
cul-de-sac.

Ms. Mohr stated that there was a comment made about losing the view of the Ridge.
Would either a pear tree or pine tree effectively cause the view to be lost?

lVlr. Swift replied staff believes that as the pear trees mature the Cravottas won't see the
gazebo or any pan of Pleasanton Ridge. A mature evergreen pear tree should end up being 5-10
feet taller than the gazebo. Staff feels one tree will screen the gazebo. The gazebo does not
extend beyond the top of the ridge when viewed from the Cravottas' residence but depending
on where you are in their backyard, it could obscure the ridge view as you get closer to it.

Ms. Mohr stated the evergreen pear tree matures at approximately twenty-five feet but
would still give the Cravottas some view of the Ridge.

Mr. Swift replied as the cedars grow the Cmvottas will not have a view of the ridge in
the one direction at all.

Mr. Tarvet declared the public hearing open on the application.

Anthony P. Cravotta, 19 Foothill Place, commented that when the fences were
constructed, as well as the gazebo, a variance was needed and the applicants did not apply for
a building permit until someone complained about it. If the fence were placed at its normal
position, the gazebo would be back twenty-five feet back. There are trees along the fence line
so the gazebo would not be allowed more than fourteen feet to the fence.

Mayor Tarver asked if a building permit would be needed for this structure?

Mr. Swift replied yes.

Mr. Cravotta stated that the area originally had lemon cyprus trees along the property
lines and they have all now been removed. He requested evergreen pear trees be placed around
the gazebo so that they will cover the gazebo when the cyprus trees die.

Mayor Tarver asked how many trees exist now and how big are they?

Mr. Cravotta stated the pictures he showed Council were old and that the trees are
planted now. He stated there are sixteen trees in the backyard now but the cyprus trees are
screening the fence and are four to five years old. The cyprus trees are higher than the fence
but not taller than the gazebo.

11/21/95 -10-
