6.68.040 <br />6.68.040 Grant Or Denial Of Police <br />Department Permit; <br />Appeals: <br />A. The Police Chief shall grant the <br />Police Department permit if all of the <br />following findings are made: <br />1. All of the information contained in <br />the application is true as determined by <br />the fingerprint document. A temporary <br />Police Department permit may be granted <br />pending the results of the fingerprint <br />report by use of other valid form of per- <br />sonal identification (e.g., valid California <br />driver's license, California identification <br />card, or passport). <br />2. The applicant agrees to abide by and <br />comply with all conditions of the Police <br />Department permit and applicable laws <br />and procedures. <br />3. The site of applicant's place of busi- <br />ness complies with applicable zoning reg- <br />ulations. <br />B. After consideration of all reports <br />and investigations, the Police Chief shall <br />deny the Police Department permit if any <br />of the following findings are made: <br />1. The application is incomplete and <br />the applicant has refused to provide the <br />requested information; <br />2. The applicant has provided false or <br />misleading information on the application; <br />3. The site proposed for the applicant's <br />business does not comply with City <br />zoning regulations; <br />4. The applicant is under the age of <br />eighteen (18); <br />5. The applicant has been convicted of <br />a felony or crime within the last five (5) <br />years involving dishonesty; fraud; deceit; <br />moral turpitude; theft; the use of force or <br />violence upon the person of another; the <br />unlawful use, possession, or sale of any <br />dangerous or deadly weapon; or the man- <br />ufacture, sale, possession or use of a con- <br />trolled substance as defined by the Cali- <br />fornia Health and Safety Code as it now <br />reads or may be amended; <br />6. The applicant is currently or has <br />been within the past five (5) years, an <br />unlawful user of a controlled substance as <br />defined by the California Health and <br />Safety Code as that definition reads or <br />may hereafter be amended; <br />7. The applicant has violated any of the <br />provisions of this Chapter; or <br />8. The applicant has been denied a <br />permit for extrasensory consulting in <br />another jurisdiction, or such permit has <br />been revoked for cause in another <br />jurisdiction or in the City. <br />C. In the event the Police Chief denies <br />an application, the Police Chief shall give <br />written notice to the applicant that the <br />applicant has the right to appeal such <br />decision to the City Manager. If the appli- <br />cant chooses to appeal the decision to the <br />City Manager, a request for hearing shall <br />be filed by the applicant with the City <br />Clerk within ten (10) days of the date of <br />the denial. The hearing on the denial shall <br />be held before the City Manager, or his <br />or her designee, within fourteen (14) days <br />of filing of the request for hearing. A <br />written determination regarding the appeal <br />shall be issued within five (5) days of the <br />hearing.
