6.68.040 6.68.040 Grant Or Denial Of Police Department Permit; Appeals: A. The Police Chief shall grant the Police Department permit if all of the following findings are made: 1. All of the information contained in the application is true as determined by the fingerprint document. A temporary Police Department permit may be granted pending the results of the fingerprint report by use of other valid form of per- sonal identification (e.g., valid California driver's license, California identification card, or passport). 2. The applicant agrees to abide by and comply with all conditions of the Police Department permit and applicable laws and procedures. 3. The site of applicant's place of busi- ness complies with applicable zoning reg- ulations. B. After consideration of all reports and investigations, the Police Chief shall deny the Police Department permit if any of the following findings are made: 1. The application is incomplete and the applicant has refused to provide the requested information; 2. The applicant has provided false or misleading information on the application; 3. The site proposed for the applicant's business does not comply with City zoning regulations; 4. The applicant is under the age of eighteen (18); 5. The applicant has been convicted of a felony or crime within the last five (5) years involving dishonesty; fraud; deceit; moral turpitude; theft; the use of force or violence upon the person of another; the unlawful use, possession, or sale of any dangerous or deadly weapon; or the man- ufacture, sale, possession or use of a con- trolled substance as defined by the Cali- fornia Health and Safety Code as it now reads or may be amended; 6. The applicant is currently or has been within the past five (5) years, an unlawful user of a controlled substance as defined by the California Health and Safety Code as that definition reads or may hereafter be amended; 7. The applicant has violated any of the provisions of this Chapter; or 8. The applicant has been denied a permit for extrasensory consulting in another jurisdiction, or such permit has been revoked for cause in another jurisdiction or in the City. C. In the event the Police Chief denies an application, the Police Chief shall give written notice to the applicant that the applicant has the right to appeal such decision to the City Manager. If the appli- cant chooses to appeal the decision to the City Manager, a request for hearing shall be filed by the applicant with the City Clerk within ten (10) days of the date of the denial. The hearing on the denial shall be held before the City Manager, or his or her designee, within fourteen (14) days of filing of the request for hearing. A written determination regarding the appeal shall be issued within five (5) days of the hearing. (Ord. 1770 § 1, 1999) 6.68.050 Term Of Police Department Permit And Renewal: A.
