3. Street Improvements. <br />A. In the event that the following street improvements <br />are constructed, Developer shall pay its pro rata share, as such <br />share is determined by the City Engineer: <br />(i) The realignment of and improvements to <br />Vineyard Avenue from the existing City limits to the boundary of <br />the Property; <br />(ii) Any improvements needed at the intersection <br />of Highway 84 and Vineyard Avenue and the intersection of Isabel <br />Avenue and Vineyard Avenue; and <br />(iii) Any intersection improvements at (a) Bernal <br />Avenue and Vineyard Avenue, (b) Valley Avenue and Stanley <br />Boulevard and (c) Isabel Avenue and Stanley Boulevard. <br />B. If necessary to accelerate the timetable for <br />construction of the realigned Vineyard Avenue in the "S" curve <br />segment, Developer shall advance funds for such construction. <br />Developer may enter into a reimbursement agreement with City or <br />request the City to create a benefit district to provide <br />Developer with repayment of any costs in excess of Developer's <br />pro rata share from owners of other properties benefitted by such <br />construction. <br />C. If Highway 84 becomes a City arterial thoroughfare <br />rather than a state highway or toll road, Developer will dedicate <br />right-of-way necessary to widen or extend the thoroughfare, and <br />will provide funds for construction of the right-of-way <br />improvements necessary to serve the Property. <br />[Draft 8/1/91] 6 <br />
