4. Water Service. <br />A. Developer shall construct the Project water system <br />to City standards. <br />B. If City water is available at the Vineyard Avenue <br />frontage of the Property at such time as Developer requires water <br />service to the Project, the City shall provide water service. <br />C. In that event Developer shall pay standard water <br />hook-up and service fees otherwise chargeable generally to <br />customers of City. In the event City water is not available at <br />such time as Developer requires water service for the Project, <br />Developer shall be entitled to obtain water service from a <br />private water system. <br />D. If Developer initially obtains water service from a <br />private water company, Developer shall thereafter be required to <br />transfer to the City water service within 24 months from the time <br />City water is available on Vineyard Avenue at the Property, at <br />connection and service rates charged to other users in accordance <br />with City ordinances and policies. <br />E. If wells, storage tanks, pipelines or other water <br />facilities are built on the Property, or built by the Developer <br />for the benefit~of the Project, Developer shall take all <br />necessary steps to ensure that such water facilities are <br />dedicated to City at the time Developer transfers to City water <br />service. <br />F. This Agreement does not guarantee the availability <br />of sufficient water to serve the Project. If, at any time after <br />[Draft 9/9/91] 7 <br />
