The proposal for a specified alternative use <br />shall be, at a minimum, a conceptual land <br />plan showing generalized street locations and <br />intended land uses; if residential, the plan <br />should indicate densities by specific areas <br />and an estimate or range of total units; if <br />commercial or industrial, the plan should <br />indicate the intensity of development and <br />general uses by area and an estimate or range <br />of total building floor area. The level of <br />specificity required for a specified alternative <br />use shall be determined by the City Council <br />as necessary to permit them to make the <br />findings required for cancellation. <br /> <br />A public hearing shall be held prior to any <br />action being taken on a petition for cancellation. <br /> <br />Notice of the public hearing shall be given <br />pursuant to the provisions of the'Williamson <br />Act, particularly Section 51284 of the Government <br />Code. <br /> <br />Following the conclusion of the public hearing, <br />the City Council may grant tentative approval <br />if it makes the findings required by the <br />applicable provisions of the Williamson Act, <br />as amended. The City Council shall establish <br />the conditions and contingencies which must <br />be satisfied, including payment of any cancella- <br />tion fee or fees and obtaining all permits <br />necessary to commence the project, prior to <br />the cancellation becoming effective. For <br />purposes of this requirement, obtaining all <br />permits up to and including final map approval <br />shall be considered "obtaining all permits <br />necessary to co~ence the project" unless, <br />due to the nature of the project, the City <br />Council sets a different requirement at the <br />time tentative approval is granted. <br /> <br />Upon receipt of notice from the landowner <br />that he has satisfied the conditions and <br />contingencies, the City Council, within <br />thirty (30) days, shall determine that the <br />conditions and contingencies have been satisfied <br />and shall execute a certificate of cancellation <br />and cause the same to be recorded. Should a <br />landowner give notice that he is unable to <br />satisfy the conditions and contingencies, the <br />City Council shall execute a certificate of <br />withdrawal of cancellation of contract and <br />cause the same to be recorded. <br /> <br />-6- <br /> <br /> <br />
