The City Council shall approve each contract by adoption of a resolution to that effect. Proposed contracts may be processed simultaneously with a request for agricultural preserve designation. If processed separately, the Planning Department report, notice, and hearing requirements of establishing a preserve shall apply. Non-renewal Procedures Non-renewal: Either the land owner or the City may elect in any given year to not renew the contract. Written notice of such non- renewal shall be served upon the City by the land owner at least ninety (90) days prior to the annual renewal date, and upon the land owner by the City at least sixty (60) days prior to the annual renewal date, or the contract shall be considered renewed. In the event of non-renewal, the existing contract shall remain in effect for the balance of the period remaining since the original execution or the last renewal, as the case may be. Cancellation Procedures A contract may not be canceled except pursuant to a request by the land owner and approval by the City Council in accordance with the provisions of the Williamson Act, as amended. Petitions for cancellation shall be filed with the Planning Department on a form prepared by the Planning Department. The petition shall include the following information: the signatures of all property owners party to the contract; a legal description of the property; the location and size of the property; the identity of the agricultural preserve and the resolution number establishing it; the owners of land under contract within the same agricultural preserve and within one mile of the exterior boundary of the property upon which the contract is proposed to be canceled, together with their mailing addresses; whether a waiver of cancellation fees is requested; a proposal for a specified alternative use of the land; and information supporting the findings necessary to cancel the contract.
