The City Council shall approve each contract <br />by adoption of a resolution to that effect. <br /> <br />Proposed contracts may be processed simultaneously <br />with a request for agricultural preserve <br />designation. If processed separately, the <br />Planning Department report, notice, and <br />hearing requirements of establishing a preserve <br />shall apply. <br /> <br />Non-renewal Procedures <br /> <br />Non-renewal: Either the land owner or the <br />City may elect in any given year to not renew <br />the contract. Written notice of such non- <br />renewal shall be served upon the City by the <br />land owner at least ninety (90) days prior to <br />the annual renewal date, and upon the land <br />owner by the City at least sixty (60) days <br />prior to the annual renewal date, or the <br />contract shall be considered renewed. <br /> <br />In the event of non-renewal, the existing <br />contract shall remain in effect for the <br />balance of the period remaining since the <br />original execution or the last renewal, as <br />the case may be. <br /> <br />Cancellation Procedures <br /> <br />A contract may not be canceled except pursuant <br />to a request by the land owner and approval <br />by the City Council in accordance with the <br />provisions of the Williamson Act, as amended. <br /> <br />Petitions for cancellation shall be filed <br />with the Planning Department on a form prepared <br />by the Planning Department. The petition <br />shall include the following information: the <br />signatures of all property owners party to <br />the contract; a legal description of the <br />property; the location and size of the property; <br />the identity of the agricultural preserve and <br />the resolution number establishing it; the <br />owners of land under contract within the same <br />agricultural preserve and within one mile of <br />the exterior boundary of the property upon <br />which the contract is proposed to be canceled, <br />together with their mailing addresses; whether <br />a waiver of cancellation fees is requested; a <br />proposal for a specified alternative use of <br />the land; and information supporting the <br />findings necessary to cancel the contract. <br />Additional information, maps, or other <br />materials may be required as necessary. <br /> <br />-5- <br /> <br /> <br />
