It is urgently necessary to complete with the utmost <br />dispatch the projects which are the subject of this agreement <br />and CITY personnel would not be available to design and could <br />not be made available to design the projects in the time frame <br />necessary. <br /> <br /> In the judgement of the City Council of the CITY, it is <br /> necessary and advisable to employ the services of CONSULTING <br /> ENGINEER for the purpose of providing engineering services in <br /> connection with the proposed roadway improvements program <br /> <br /> entitled "North Pleasanton Improvement District, Project AD <br />1982-4 . <br /> <br /> I' <br /> <br /> CONSULTING ENGINEER is willing and able to provide said <br />services. <br /> <br /> NOW, THEREFORE, in consideration of the recitals and the <br />mutual promises contained herein, CITY and MARK THOMAS & CO. <br />INC. agree as follows: <br /> <br /> 1. Employment of CONSULTING ENGINEER: CITY agrees <br />tO employ CONSULTING ENGINEER and CONSULTING ENGINEER agrees <br />to perform engineering services for CITY in accordance with <br />the provisions hereinafter contained in this Agreement. <br /> <br /> <br />
