~tEI~AS, certain consideration on the part of the City, <br /> <br />as set forth in said resolution, ~s to be provided to Developer <br />in exchange for Developer's participation in the Affordable <br />Housing Program, namely: <br /> <br /> 1. Priority processing through the City review <br /> process culminating in a definite date when <br /> building permits are to be issued~ <br /> <br /> 2.Postponement of the collection of certain City <br /> <br /> fees and charges related to the development; <br /> <br /> 3, Absorption by the City of any staff overtime costs <br /> involved in the review of the project; <br /> <br /> 4. Guaranteed sewage treatment capacity for the <br /> <br /> project as a part of the City's capacity allotment <br /> at the Dublin San Ramon Services District facility; <br /> and <br /> <br /> ~,~EREAS, Developer has proposed certain sales prices, <br />buyer financing programs and sales priority systems as <br />consideration for participating in the Affordable tlousing <br />Program, <br /> <br /> NOW, THEREFORE, in consideration of the faithful performance <br />of the promises, terms, conditions, and covenants set forth <br />herein by the C~ty and Developer, the parties hereto agree <br />as follows: <br /> <br />1. Time of Essence. Time is of the essence in the performance <br />of this agreement. The parties agree that the obligations <br />set forth herein are to be met in a timely manner. <br /> <br />2.
