4. The Johnson Drive realignment must be completed to <br />afford access to the Pleasanton Park industrial project now <br />under construction, and acquisition of the right-of-way for <br />the realigned street is urgently required. Completion of <br />the appraisal according to the terms of this agreement is <br />necessary in order to meet the construction timetable required <br />to provide access to Pleasanton Park. <br /> <br /> 5. Appraisers and City have reached agreement concerning <br />the content of the appraisal services to be rendered and the <br />consideration therefor and now desire to set forth their <br />respective understandings and agreement pertaining thereto <br />in writing. <br /> <br /> THE CITY AND APPRAISERS AGREE AS SET FOF~tl BELOW: <br /> <br />I. Scope of Work <br /> <br /> Appraisers agree to prepare an appraisal report a~equate <br /> <br />and sufficient to enable City's right-of-way agents to <br />negotiate the acquisition of real property within the proposed <br />right-of-way of the realigned Johnson Drive west of Hopyard <br />Road, as more particularly shown on the map identified as <br />Exhibit "A", attached hereto and incorporated herein by this <br />reference, and, if necessary, to enable City to acquire <br />immediate possession of the property through eminent domain <br />proceedings. Said appraisal shall specifically include the <br />following: <br /> <br /> A. Appraisal of the fee interest in the right-of-way <br /> within the lands occupied by Denny's ~estaurant, <br /> Hungry Hunter Restaurant, Chevron Service Station, <br /> and Harris Realty offices. <br /> -2- <br /> <br /> <br />
