Realignment Plan will be financed and constructed and to <br />establish the parameters for a formal agreement encompassing <br />these understandings. <br /> <br /> NOW, THEREFORE, the parties mutually agree that each <br /> <br /> an agreement containing <br /> <br />and every party hereto will execute <br />the following: <br /> <br />1. Obligations of R & B <br /> 1.1. <br /> <br />1.2. <br /> <br /> R & B agrees to cooperate to allow City t6 delete <br /> all work under Assessment District 1981-1 which <br /> is unnecessary under the Realignment Plan. The <br /> deleted work includes: <br /> a. improvements to Johnson Drive along those <br /> <br /> portions planned to be abandoned. <br /> <br />b. improvements to Johnson Drive at the Hopyard <br /> <br /> Road intersection which are planned to be <br /> superseded by the Realignment Plan. <br /> <br /> R & B agrees to allow City to redirect the unexpended <br /> funds under Assessment District 1981-1 to be used <br /> <br /> (1) to construct Owens Drive within the boundaries <br /> of Pleasanton Park pursuant to the Realignment <br /> <br /> Plan; and (ii) to construct the realigned Johnson <br /> Drive not originally a part of Bannister Drive <br /> northerly of Owens Drive to the western boundary <br /> of Pleasanton Park pursuant to the Realignment <br /> <br /> Plan. Should the unexpemded funds under Assessment <br /> District 1981-1 be insufficient to complete the <br /> above improvements, R & B agrees to finance their <br /> construction. R & B further agrees to finance all <br /> <br /> <br />
