Section 1. Recognition <br /> <br /> Local 1974, International Association of Fire Fighters, <br /> AFL-CIO-CLC, hereinafter referred to as the "Union," is <br /> the formally recognized employee organization for the <br /> Fire Employees Unit comprised of the classifications <br /> of Firefighter, Fire Lieutenant, and Fire Captain, <br /> certified pursuant to the Employer-Employee Relations <br /> Procedures & Resolution No. 71-75, adopted by the City <br /> of Pleasanton City Council on April 5, 1971. <br /> <br />Section 2. Union Security <br /> <br />2.1 <br /> <br />Dues Deduction <br /> <br /> Upon receipt of a written assignment and authorization <br />'signed by the employee on the form shown below, the <br /> City agrees to deduct from an employee's paycheck an <br /> amount which will total the dues uniformly required for <br /> membership in the Union. The amount so deducted shall <br /> be remitted by the City to the~officer designated in <br /> writing by the President of the Union as the person <br /> authorized to receive such funds. <br /> <br />The President of the Union shall notify the City Mahager <br />in writing as to the amount of such dues uniformly required <br />of all members of the Union. <br /> <br />The employee's earnings must be regularly sufficient after <br />other legal and required deductions are made ~o cover the <br />amount of the dues checkoff authorized. When an employee <br />is in a non-pay status for an entire pay period, no with- <br />holding will be made to cover that pay period from future <br />earnings. In the case of an employee who is in a non-pay <br />status during only part of the pay period, and the salary <br />is not sufficien% to cover the full withholding, no <br />deduction shall be made. In this connection, all other <br />-legal and required deductions have priority over union <br />dues. In addition, in order to meet certain accounting <br />deadlines, all payroll changes connected with the <br />deduction of said union dues must be made by the fif- <br />teenth (15th) of the preceding month. <br /> <br />The Union and the International Association of Fire <br />Fighters, AFL-CIO-CLC, shall indemnify, defend, and hold <br />the City harmless against any and all claims, demands, <br />suits, proceedings or court orders, or any other liability <br />that may arise out of or by reason of action taken or not <br />taken by the City for the purpose of complying with any of <br />the provisions of this check-off agreement. In addition, <br />the Union shall refund to the City any amounts paid Go <br />it in error upon presentation of supporting evidence. <br /> <br />-2- <br /> <br /> <br />
