9.9.82 <br />C169-107 <br /> <br />City'S standard requirements and procedures utilizing what- <br />ever capacity exists until such time as the Additional <br />Capacity is available, and the capacity made available to <br />the Lot by the City pursuant to such applications shall be <br />charged against the Lot Allocation. Upon notification by <br />the City of the availability of the Additional Capacity, the <br />owner of the Lot shall not apply for or purchase other <br />capacity from the City beyond the Lot Allocation until the <br />Valley Business Park Sewer Allocation is exhausted. <br /> <br /> 4. Assignment and Release. Sente, Valley, and <br />Purchaser shall execute and have acknowledged and recorded a <br />Sewer Assignment, Assumption, and Release Agreement (the <br />"Sewer, Assignment, Assumption, and Release Agreement") in <br />the form of Exhibit B whereby Purchaser is assigned the Lot <br />Allocation and assumes the obligations of Sente and Valley <br />under the Allocation Agreement with respect to the Lot. <br />Upon recordation of the Sewer Assignment, Assumption, and <br />Release Agreement, Sente and Valley shall be released from <br />further obligation to the City with respect to the obliga- <br /> <br />tions assumed by Purchaser. Upon recordation, Purchaser <br />shall deliver a copy of the Sewer Assignment, Assumption, <br />and Release Agreement, as recorded, to the City. Valley or <br />Sente, or both, shall keep a master list of assignments <br />pursuant to this agreement and furnish said list to the City <br />upon request. <br /> <br />-5- <br /> <br /> <br />
