9.9.82 " ' <br />C169-107 <br /> <br />("Lot Allocation") by the Sewer Assignment, Assumption, and <br />Release Agreement (defined in Paragraph 4) shall be avail- <br />able to the Lot upon application to the City for building <br />permits or sewer connection permits ("Permits"). The City <br /> <br />shall issue Permits based on the portion of the Lot Alloca- <br />tion the City estimates will be used on the Lot pursuant to <br />the application for Permits. The City shall not issue <br />Permits for the Lot which alone or in the aggregate exceed <br />the Lot Allocation. Except as provided in the Allocation <br />Agreement, nothing herein shall be deemed to require the <br />City to grant Permits for lots in Valley Business Park if <br /> <br />the City determines that sewer capacity allocated to lots in <br /> <br />Valley Business Park has reached the Valley Business Park <br />Sewer Allocation. <br /> <br /> 2. Surcharge. The City shall bill the owner of <br />the Lot for the surcharge payable to the City pursuant to <br />the formula contained in Exhibit B to the Allocation Agree- <br /> <br />ment, in addition to all regular sewer connection fees, for <br />the portion of the Lot Allocation estimated to be used on <br />the Lot at the time the Permits are secured. <br /> <br /> 3. Other Capacity. The owner of the Lot may <br />apply for and purchase sewer connections for the Lot, up to <br />but not exceeding the Lot Allocation, in accordance with the <br /> <br />-4- <br /> <br /> <br />
