Agreement <br />Page 2 <br /> <br />WHE_~RF~AS, <br /> <br />City has by agreement and as a member agency of the <br />Livermore hador Valley Water Management Agency (LAVWMA) <br />an entitlement of 500,000 gallons per day of capacity <br />in the LA~q~ export pipeline such entitlement and <br />conditions under which entitlement is available to City <br />is set forth in the LA~MA Joint Powers Agreement, attached <br />hereto as Exhibit C and incorporated herein by reference; <br />and <br /> <br />WHEREAS, City is subject to conditions dictated by the State of <br /> California Department of Water Resources and the U. S. <br /> Environmental Protection Agency as a result of <br /> accepting grant funds for several sewer projects; a~d <br /> <br />WHEREAS , <br /> <br />Dublin San Ramon Services District has accepted grant <br />funds from the State Department of Water Resources <br />and the U. S. Environmental Protection Agency and is <br />subject to conditions similar to those applicable to <br />City; and <br /> <br />WHEREAS , <br /> <br />in response to inquiry by City the State Department of <br />Water Resources has indicated in a letter dated <br />January 2, 1979, attached hereto as Exhibit D <br />and incorporated herein by reference, some of the con- <br />ditions which must be addressed in order to proceed with <br />an expansion of the Dublin San Ramon Services District <br />Treatment Plant; and <br /> <br />WHEREAS, <br /> <br />it is expected that within the next two years City will <br />no longer operate a sewage treatment plant and all <br />sewage treatment for the City will be provided by and <br />under an existing agreement with the Dublin San Ramon <br />Services District; and .. <br /> <br />WHEREAS , <br /> <br />Owner acknowledges that City cannot act unilaterally in <br />providing Owner with sewage treatment capacity and that <br />the cooperation and approval of the Dublin San Ramon <br />Services District, Livermore-Amador Valley Water Manage- <br />ment Agency, the State Department of Water Resources, <br />the U. S. Environmental Protection Agency, and other <br />governmental agencies which may in the future exercise <br />jurisdiction, is required. <br /> <br />NOW, THEREFORE, in consideration of the faithful performance of the <br /> <br />terms, conditions, covenants and promises contained herein, the <br /> <br />parties hereto agree as follows: <br /> / <br /> <br /> <br />
