CITY A. agrees to the following: LIMITED OBLIGATION The City hereby states and declares that the obligations of City provided herein are promises of the good faith efforts by the City and are expressly not commitments and guarantees to cause certain actions to occur to the satisfaction of Owner. COOPEP~TION TO EXPAND SEWER PLANT City shall cooperate and work with Owner to the end that the Dublin San Ramon Services District Treatment Plant ah~ LA~qMA Export Pipeline and related facilities are expanded, at no cost to City, to provide sewage treatment capacity for properties in the City of Pleasanton in- cluding the property of the Owner. COOPERATION: ENVIRONMENTAL CONSIDERATIONS City shall cooperate and work with Owner to address all environmental considerations necessitated by previous conditions applicable to City, Dublin San Ramon Services District and LA~MA. EXPANSION REQUEST City shall request and enter into agreement with the Board of Directors of the Dublin San Ramon Services District to expand their sewage treatment plant. P~EQUEST FOR OTHER AGENCY APPROVALS City shall request and enter into agreements with the Board of Directors of the Livermore Amador Valley Water Management Agency to authorize and approve the expansion of their facilities to accommodate the 500,000 gallons per day reserved for City in the LA~qMA Joint Powers Agreement. ELECTION MEASURE - City shall place before the voters of the City of Pleasanton a measure seeking the approval of the voters to utilize the 500,000 gallons per day of capacity reserved for City in the LA~[i~ Joint Powers Agreement if required by LA~b~ to do so as a condition to purchasing pipeline capacity. tf so required the City will place said measure before the voters of the City of Pleasanton at the regularly scheduled municipal election in April, 1980 or the primary election of June, 1980 and the selection of either election is at the discretion of City. City Council may, at its discretion, call a special election as may be necessary under this section. All costs specifically related to placing the measure required by LA~.3>~ befo~ the voters shall be paid by O~er to City.
