AGREE~LENT <br />THIS AGREEMENT entered into this ~.d~ay of <br /> <br />by and between the CITY OF PLEASANTON, a municipal <br /> <br />, 1979, <br />corporation <br /> <br />(hereina~ter referred to as "City"), and WILLOW WEST PROPERTIES, a <br /> <br />co-partnership, with offices at 1385 West San Carlos, San Jose, <br /> <br />California 95126 (hereinafter referred to as "Owner"). <br /> <br />%'~LEREAS,' Willow West Properties, is the owner of approximately <br /> 360 acres of real property in the City of Pleasanton, <br /> which is set out in Exhibit A, attached hereto and <br />~ incorporated herein by reference; and <br /> <br />WHEREAS , <br /> <br />the real property owned by Willow West Properties, and <br />described in Exhibit A is zoned for commercial and <br />industrial uses and Owner is desirous of initiating the <br />development of the property; and <br /> <br />WHEREAS, <br /> <br />circumstances and conditions currently existent within <br />the City of Pleasanton are such that sewage treatment <br />capacity for development of Owner's property does not <br />now exist; and <br /> <br />WHEREAS , <br /> <br />circumstances and conditions within the City of Pleasanton <br />make it unlikely that sewage treatment capacity will be <br />available for the development of Owners property in the <br />imaediate future; and <br /> <br />WHEREAS , <br /> <br />~ner has approached and formally requested the City to <br />act on behalf of Owner and request the Board of Directors <br />of the Dublin San Ramon Services District to expand the <br />capacity of the Dublin San Ramon Services District <br />Treatment Plant and alternatively to support the con- <br />struction of a discrete sewage treatment plant designed, <br />constructed and financed by Owner; and <br /> <br />WHEREAS , <br /> <br />City requested that the Board of Directors of the Dublin <br />San Ramon Services District allow the expansion of the <br />Dublin San Ramon Services District Treatment Plant to <br />accommodate the development of Owner's property; and <br /> <br />WHEREAS, <br /> <br />the Board of Directors of the Dublin San Ramon Services <br />District responded affirmatively to request of City <br />on behalf of Owner, such response contained in a letter <br />dated August 16, 1978 and subject to the conditions <br />stated therein and attached hereto as Exhibit B <br />and incorporated herein by reference; and <br /> / <br /> EXHIB IT "A* <br /> <br /> <br />
