The Allocation Agreement involves the allo- <br />cation of sewer capacity to that certain real property (the <br /> <br />"Property"), designated as of the date of the Allocation <br />Agreement as Tract 4326 and now commonly known as Valley <br />Business Park ( "Valley Business Park" ), in the City of <br /> <br />Pleasanton, County of Alameda, and more particularly des- <br />cribed as Lots 12 through 30, inclusive, and 35 through 38, <br />inclusive, as sho~ on that certain map entitled Tract 4889, <br />Valley Business Park, recorded September 16, 1981, in Book <br />129 of Maps, Pages 88 to 91, inclusive, Official Records of <br />Alameda County, and Lots A through M, inclusive, as shown on <br /> <br />that certain map entitled Parcel Map No. 3860, recorded <br />August 19, 1982, in Book 135 of Maps, Pages 59 to 62, <br />Official Records of Alameda County; <br /> <br /> c. The Allocation Agreement allocates to Valley <br />Business Park (the "Valley Business Park Sewer Allocation") <br />the lesser of (i) 63,000 gallons per day, or, (ii) sixty- <br />three/five hundredths (63/500ths), of the additional sewer <br />capacity (the "Additional Capacity") to be created pursuant <br />to that certain Amended Agreement (the "Willow West Agree- <br />ment,a) executed on or about October 16, 1980, by and among <br />the City, Willow West Properties, and The Prudential Insur- <br /> <br />ance Company of America, a copy of which is attached as <br />Exhibit A to the Allocation Agreement; <br /> <br /> D.
