Eliminate the following listed public grade crossings across tracks and rights-of-way of the SPTC upon the abandomnent and reamval of existing railroad tracks, and restore street pavements, gutters, and sidewalks following the removal of said railroad tracks: a. Main Street, CPUC Crossing No. D-40.6. b. Abbie Street, CPUC Crossing No. D-40.?. c. Angela Street, CPUC Crossing No. D-40.8. d. West Neal Street, CPUC Crossing No. D-40.9. e. Spring Street, CPUC Crossing No. D-41.1.. f. P~y Street, CPUC Crossing No. D-41.2, g. Stanley Boulevard, CPUC Crossing No. D-41.5. 9. Maintain all street portions of the pro~ect as constructed within CITY, and make no claim against COUNTY at any time for any portion of such maintenance expense. SECTION II - COUNTY FOR AND IN CONSIDERATION OF THE COVENANTS AND ~ONDITIONS ~ BE KEPT AND PERFORMED BY CITY, AS PROVIDED HEREIN, COUNTY AGREES TO: 1, Cause the preparation of plans and specifications for the construc- tion of a two-lane underpass structure and appurtenant approaches on Pleasanton- Sunol Road at WPRR milepost 37.~, said plans and specifications to be in accord- ance with the requirements set forth in paragraph 7, Part 1, of the aforesaid four-party track consolidation project agreement entered into on March 23~ lg82, and to be submitted to the WPRR for review and approval prior to the advertising and awarding of any construction contract for the said underpass structure and appurtenant approaches. 2. Acquire any rights-of-way required for COUNTY'S portion of the project. 3. Prepare contract documents, advertise for bids and award a construc- tion contract, provide construction engineering, ana certify the completed - 3 -
