NILES-PLEASAItTON TRACK CGt~SOLiGATIGN PRGGECT <br /> <br />work for the underpass structure identified in paragraph 1 above, and for the <br />CITY's portion of the project as set forth in paragraph 4 of SECTION I hereof as <br />so authorized by CITY. <br /> <br /> 4. Eliminate the following listed public grade crossings across tracks and <br />rights-of-way of the SPTC upon the abandonment and removal of existing railroad <br />tracks, and restore roadway pavements and any appurtenant facilities following <br />removal of said railroad tracks: <br /> <br /> a. Kilkare Road, Sunel, CPUC Crossing No. 0~35.6. <br /> b. Bond Street, Sunel, CPUC Crossing No. D-35.8. <br /> c. Pleasanton-Sunol Road, CPUC Crossing No. D-3B.3, <br /> S. Cause the preparation of plans and specifications, prepare contract <br />documents, advertise for bids and award a construction contract, provide construc- <br />tion engineering, and certify the completed work for the realignment and recon- <br />struction of the portion of Pleasanton-Sunol Road at CPUC Crossing No. O-3B.3 <br />following abandonment and removal of existing railroad tracks in order to <br />eliminate certain sharp reverse curve approaches thereto, <br /> <br /> 6. Remove the existing superstructure at CPUC Crossing No. 4-37.2-B on the <br />Pleasanton-Sunol Road upon completion of the new underpass structure and. appurtenant <br />approaches covered in paragraph 1 above, and restore the roadway in an appropriate <br /> <br /> 7. Maintain all roadway portions of the project as constructed within the <br />unincorporated area of COUNTY, and make no claims against CITY at any time for any <br />portion of such maintenance expense. <br /> <br /> B. Place CITY's deposit required to be made by paragraph S of SECTION I above <br /> <br />in an interest bearing trust account, with the interest derived therefrom to be credited <br />at the end of each quarter to the aforesaid trust account. Withdrawals of the deposited <br />amount and accumulated interest from the afo~esaid interest-bearing trust account will <br />be made as necessary to cover payment for CITY's portion of the project. <br /> <br /> 9. Upon completion and acceptance by COUNTY of COUNTY'S construction contract <br />for the project improvements noted above, to furnish CITY with a detailed statement <br />of costs to be borne by both CITY and COUNTY, and to.refund to CITY any amount of <br />CITY's d~posited funds remaining after total costs to be borne by CITY have been <br />deducted. <br /> <br /> - 4 - <br /> <br /> <br />
