nant approaches on the De1 Valle Parkway extension at WPRR milepost 41.8, <br />said plans and specifications to be in accordance with the requirements set <br />forth in paragraph 7, Part 1, of the aforesaid four-party track consolidation <br />project agreement entered into on Harch 23, 1982, and to be submitted to the <br />WPRR for review and approval prior to the advertising and awarding of any <br />construction contract for the said underpass structures and appurtenant <br />approaches. <br /> <br /> 2. Cause the preparation of plans and specifications for the construc- <br />tion of a street on the easterly side of the main Mne of the WPRR between the <br />northerly line of Rose Avenue and the southerly line of St. Mary's Street to <br />provide for local traffic circulation which would otherwise be disrupted by <br />closure of the Division Street grade crossing (CPUC Crossing No. <br /> <br /> 3. Contract With COUNTY for the acquisition of ali rights-of-way <br />required in connection with CITY's portion of the project, said acquisftion~ <br />to be accomplished at CITY's expense. <br /> <br /> 4. Authorize COUNTY to prepare contract documents, advertise for bids <br />and award a construction contract, provide construction engineering, and <br />certify the completed work for each of the underpass structures-and approaches <br />covered i n paragraph ! above and the street construction work covered in <br />paragraph 2 above. Said authorization shall be through CITY resolution. <br /> <br /> 5. Deposit with COUNTY, within 10 days of receipt of billing therefor <br />(which billing will be for~arded immediately following COUNTY'S award of a <br />construction contract for the aforesaid underpass structures and approaches <br />and other pro3ect street construction work), seventy-five p~cent (75~) of <br />the construction contract bid amount remaining after deducting the sum of <br />$5,000,000 frem the aforesaid contract b~d amount. <br /> <br /> 6. Pay to COUNTY, promptly upon receipt of billing therefor, any <br />amount over and above C~TY'S advance deposit, as provided in paragraph 5 <br />above, required to complete CITY's financial obligations. <br /> <br /> 7.
