AGREEMENT BETWEEN COUNTY OF ALAMEDA AND CITY OF PLEASANTON IN CONNECTION WITH THE NILES-PLEASANTON TRACK CONSOLIDATION PROJECT THIS AGREEMENT is made and entered into by and between the CITY OF PLEASANTON, a municipal corporation, hereinafter referred to as CITY, and the COUNTY OF ALAMEDA, a political subdivision of the State of California, hereinafter referred to as COUNTY. WITNESSETH WHEREAS, CITY and COUNTY previously entered into a four-party agreement with the Southern Pacific Transportation Company (SPTC), a corporation, and lhe Western Pacific Railroad Company (WPRR}, a corporation, on March 23, 1982, in connection with the proposed consolidation of the main line tracks of the two aforesaid corporations between the Niles railroad Junction and the City of Pleasanton; and WHEREAS, a portion of the proposed track consolidation project is within the unincorporated areaof COUNTY and a portion is within CITY} and WHEREAS, it is the mutual desire of CITY and COUNTY to enter into this agreement to set forth their respective engineering, construction, and financial responsibilities in connection with the aforesaid track consolidation project, heroinafter referred to as project; and WHEREAS, such agreement is authorized and provided for by provisions of Section 6500 et seq. of the Government Code of the State of California; NOW, 1HEREFORE, IT IS AGREED AS POLLOWS: SECTION I - CITY FOR AND IN CONSIDERATION OF THE COVENANTS AND CONDITIONS TO BE KEPT AND PERFORMED BY COUNTY, AS PROVIDED HEREIN, CITY AGREES TO: 1.
