underground (communication) facilities, subject to the conditions <br />that, in accordance with Company's tariffs, rules and regulations <br />on file with the Public Utilities Commission of the State of <br />California, (a) the customer or applicant furnishes, installs and <br />maintains at its expense on the property to be served the required <br />underground supporting structure in accordance with Company's <br />specifications, and (b) such customers and applicants pay any <br />applicable charge in so furnishing such service. <br /> <br /> 6. Company shall not be responsible for any delay in the <br />work to be performed by it hereunder, which is beyond Company's <br />reasonable control. In the event Company is unable to obtain <br />supplies, materials or labor for all of its requirements~ Company <br />shall have the right to allocate materials and labor to <br />construction projects which, in its sole discretion, it deems most <br />important to serve the needs of its customers and applicants for <br />service, and any delay in the performance of work under this <br />Agreement resulting from such allocation shall be deemed a delay <br />beyond Company's reasonable control. <br /> <br /> 7. Upon completion of the construction and installation <br />of said underground supporting structure, in accordance with <br />Paragraphs 2 and 3 above, title to said complete underground <br />supporting structure shall vest in Company pursuant to California <br />Streets and Highways Code, Section 10111, free from all liens, <br />claims, and encumbrances. <br /> <br />8. If, for any reason, all of the provisions of <br />Paragraphs 2 and 3 hereof have not been complied with on or before <br /> <br />- 4 - <br /> <br /> <br />
