WHEREAS, on October 27, 1981, the City Council of City <br />adopted Resolution No. 81-369 entitled "Resolution Approving Report <br />and Assessment and Ordering Improvement, Assessment District No. <br />1981-1, Pleasanton Park; and <br /> <br /> WHEREAS, the acquisitions and improvements provided for in <br />said Resolution No. 81-369 include, but are not limited to, the <br />underground supporting structure required for Company's proposed <br />system of underground communications facilities within District; <br />and said underground supporting structure as proposed is shown on <br />Exhibit A, attached hereto and made a part hereof, and will provide <br />adequate service outlets for furnishing normal communications <br />services to each of the buildings which Company understands are to <br />be constructed within said District; and <br /> <br /> WHEREAS, Company is willing to~construct such underground <br />facilities to and within the District in advance of the requirement <br />for telephone service therein in accordance with Company's Rules 15 <br />III.B., 16 I.C.l.a., (Schedule Cal. P.U.C. 36-T), and under the <br />following terms and conditions: <br /> <br /> NOW, THEREFORE, the parties hereto mutually agree as <br /> <br />follows: <br /> <br /> 1. The term "underground supporting structure" includes <br />the conduit, manholes, handholes, and service boxes where and as <br />required, plus trenching costs. The term "trenching costs" means <br />and includes the cost of excavating, backfilling and compacting, <br />and where necessary, the cost of breaking and repaving pavement and <br />of restoring landscaping. <br /> <br />- 2 - <br /> <br /> <br />
