units more than the number of sewer ~ermits available to the <br />Parcel); and <br /> <br /> WHEREAS, Developer desires to reduce the parkland <br />dedication shown on the Tentative MaD from 8.54 acres to 8.12 <br />acres, a reduction of .42 acres; and <br /> <br /> WHEREAS, City desires to mitigate the effects of ongoing <br />development, including particularly development on the <br />subject Parcel, on existing residences along Valley Avenue <br />between Hopyard Road and Santa Rita Road by causing the <br />installation of sound walls as appropriate at that location; <br />and <br /> <br />WHEREAS, City may enter long-term agreements with <br />project developers meeting the requirements for such agreements <br /> <br />pursuant to Ordinance No. 1023 <br />and the implementing procedures <br />82-66; and <br /> <br />(Growth Management Program) <br />contained in Resolution No. <br /> <br /> WHEREAS, City and Developer wish to enter into a long- <br />term agreement in order to achieve the benefits of the <br />Project and the Valley Avenue soundwall to City and its <br />residents while maintaining conformity with the City's <br />General Plan growth policies; <br /> <br /> NOW~ THEREFORE, City and Developer hereby agree as <br />follows: <br /> <br />I. GRO~H MANAGEMENT APPROVAL <br /> <br /> A. This agreement shall supersede and replace the <br /> <br />August 24, 1982 agreement between City and Developer. <br /> <br />-2- <br /> <br /> <br />
