LONG-TERM AGREEMENT <br /> <br /> THIS LONG-TERM AGREEMENT is made and entered into on <br />the 22nd day of November, 1983, by and between MORRISON <br />HOMES (hereinafter referred to as "Developer") and the CITY <br />OF PLEASANTON, a municipal corporation, (hereinafter referred <br />to as "City"). The Developer and City agree as set forth <br />below. <br /> <br /> WITNESSETH: <br /> <br />Developer is the owner of real property in the <br /> <br /> WHEREAS, <br /> <br />City of Pleasanton described in Exhibit A, attached to this <br />agreement and made a Dart of it by reference, which consists <br />generally of 66 acres located between Santa Rita Road and <br />the Southern Pacific railroad tracks immediately north of <br />Valley Avenue (.the "Parcel"); and <br /> <br /> ~EREAS, City and Developer entered into a Long-Term <br />Agreement on August 24, 1982 which provided for phased <br />approval for one hundred and ninety-five (195) units; and <br /> <br /> WHEREAS, at the time of the August 24, 1982 agreement, <br />the Developer owned and controlled two hundred and sixty- <br />four (264) sewer permits pursuant to the November 8, 1972 <br />Settlement Agreement and subsequent proceedings (i.e. DeveloDer <br />has sixty-nine (69) sewer permits which are not yet the <br />subject of a long-term agreement with the City); and <br /> <br /> WHEREAS, Developer has presented a PUD application to <br />the City proposing ultimate buildout of the Parcel with two <br />hundred and seventy-nine (279) units (i.e. fifteen (15) <br /> <br />-1- <br /> <br /> <br />
