7. Liability. <br />harmless and defend <br />of the City Council, <br />against any and all <br /> <br /> Lessee agrees to indemnify, hold <br /> <br />the City of Pleasanton (Lessor), members <br /> <br />their agents, servants and employees <br />claims for liability, for any injury to <br /> <br />or death of any person, or damage to any property whatsoever <br />caused by, created by or in any way connected with the <br /> <br />Lessee's use of the subject building. It is further agreed <br />that Lessee will name the City, members of the City Council, <br />their agents, servants and employees as additional insureds with <br />with respect to liability resulting from the use of said <br />facilities by Lessee and the conduct of Lessee's activities <br />at City's facilities. Lessee agrees to deliver to City upon <br />execution of this agreement, a Certificate of Insurance, <br />satisfactory in form to the City Attorney, showing that <br /> <br />Lessee has obtained a continuing policy <br />fying and holding harmless City against <br />in the amount of $500,000 for injury to <br /> <br />of insurance indemni- <br />any and all claims, <br />any one person and <br /> <br />$100~000 for property damage, providing for ten (10) days <br />notice to City prior to cancellation and shall keep same <br />enforced during the term of this agreement. Lessee is not <br />obligated to provide fire insurance for the structure. <br /> <br /> 8. Termination by Lessor. Lessor may terminate this <br />lease at any time it should be determined by the City Council <br />that the public necessity and convenience require it to do <br />so, by serving upon Lessee a written notice of its election <br />so to terminate~ which said notice shall be served at least <br />sixty (60) days prior to the date named in such notice for <br /> <br />-3- <br /> <br /> <br />
